Introduction

These Terms and Conditions ("Terms") govern your use of beYANG's (“we”, “us”, “our”) historical market data platform and related services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use our services.

Use of Services

We grant you a temporary, strictly personal, revocable, non-transferable limited license to use the Service solely for non-commercial purposes. Your license is personal to you, and you may not transfer or share your license with any other person. No intellectual property rights or other rights are transferred with this license.

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account and password.

Intellectual Property

The content, features, and functionality of our platform are owned by beYANG and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Data Usage and Limitations

Our historical market data is provided for informational purposes only. You agree not to:

• Redistribute or resell our data without prior written consent
• Use our data for any illegal activities
• Attempt to reverse-engineer our data collection methods
• Exceed the usage limits specified in your subscription plan
• Use the data to create financial products without our express permission
• Display or redistribute any data to any third party who is not an authorized user

Subscription and Payments

Subscription fees are billed in advance on a recurring basis. You are responsible for paying all fees associated with your account. Failure to pay may result in the termination of your access to our services. For contracts with a yearly commitment, in the event of termination due to non-payment, we reserve the right to issue an invoice for the remainder of the commitment period. This invoice will cover the outstanding balance for the unused portion of your subscription term.

Termination

We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without prior notice, for any reason, including breach of these Terms.

Limitation of Liability

beYANG shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting a notice on our website or sending you an email. Your continued use of the Service following such changes will constitute your acceptance of those changes.

Exclusion of Warranties

NOTHING IN THESE TERMS, INCLUDING THIS SECTION, SHALL EXCLUDE OR LIMIT OUR WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

IN PARTICULAR, BEYANG, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO YOU THAT:

• YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS,
• YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR,
• ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, AND
• THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BEYANG OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

BEYANG FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

THE SERVICE DOES NOT CONSTITUTE AT ANY TIME ANY KIND OF LEGAL OR TAX ADVICE. THE INFORMATION PROVIDED RELATES TO A DYNAMIC, HIGH RISK TYPE OF ASSET AND IS SUBJECT TO PERMANENT CHANGE. CRYPTOCURRENCY IS NEITHER SUBJECT TO A CENTRALIZED REGULATION BODY NOR IS BACKED BY ANY CORRESPONDING VALUE.
